Terms and Conditions of Participation

Participation in the raffle by Wahbio GmbH, hereinafter referred to as the operator or organizer, is free of charge and is subject solely to these terms and conditions of participation.

Raffle Procedure

The raffle will run from 06.12.21, 12:00 pm noon to 17.12.21. During this period, users will be given the opportunity to enter the raffle online.

Conditions of Participation

In order to participate in the raffle, you need to subscribe to Wahbio GmbH's business account on Facebook or Instagram and respond to the post on the 2021 St. Nicholas raffle by tagging two friends. Participation is possible only within the participation period. Submissions received after the closing date will not be taken into account in the draw.

Only one submitted entry per participant will be eligible to enter the raffle. The use of multiple email addresses or multiple Facebook profiles to increase the chances of winning is strictly prohibited.

Participation in the raffle is free of charge.

Eligible Participants

Participation is open to natural persons who are residing in Germany and have reached the age of 14. Participation is not limited to customers of the organizer and is not dependent on the purchase of goods or services.

If a participant has limited legal capacity, the consent of his/her legal representative is required.

Not eligible to participate in the raffle is anyone involved in the designing and realization of the raffle and the operator's staff as well as their family members. Moreover, the operator retains the right, at its own discretion, to exclude individuals from participation if there are justified reasons, for example

(a) in the event of manipulation in relation to the access to or implementation of the competition, (b) in the event of violations of these terms and conditions of participation, (c) in the event of unfair actions or (d) in the event of false or misleading information in connection with participation in the raffle.

Winner, Notice and Delivery of the Prize

The following prizes will be awarded:

Prize 1: Wahbio full package - includes 4x 450gr Wahbio Protein with the flavors Pure, Wild Berry, Peruvian Chocolate and Vanilla, with an additional protein shaker and a measuring spoon, worth 111.74 euros.

The winners will be determined after the closing date as part of a random draw among all participants. If the raffle is linked to a specific task, only those participants who have completed the task correctly will be included in the raffle.

The winners of the raffle will be informed of the prize in a timely manner via a separate private message sent to the corresponding social media account.

The prize will be handed over to the winner or the legal representative of the minor winner only. An exchange, a self-collection or a cash payout of the prize is not possible.

Any costs incurred for shipping the prizes will be borne by the operator. Any additional costs associated with claiming the prize shall be borne by the winner. The winner is responsible for any taxation of the prize.

If the winner does not respond after two reminders within a period of 3 weeks, the prize can be transferred to another participant.

Termination of the Raffle

The organizer explicitly retains the right to terminate the raffle without prior notice and without providing any reasons. This applies in particular to any reason that would disrupt or prevent the scheduled course of the raffle.

Data Protection

Participation in the competition requires the provision of personal data. The participant assures that the personal data provided are true and correct, in particular the first name, surname and the recipient's address.

The organizer hereby declares that all personal data of the participant will neither be passed on to third parties nor made available to them for any use without the participant's consent.

An exception is made for the freelancer commissioned to carry out the raffle, design by Jennifer Scharf, who must collect, store and use the data for the purpose of carrying out the raffle.

If a winner is chosen, the winner agrees to the publication of their account name on Facebook or Instagram in the advertising media used by the organizer. This includes the announcement of the winner on the operator's website and its social media platforms.

The participant may revoke their declared consent at any time. The revocation must be sent in writing to the organizer's contact details provided in the imprint area of the raffle app. Upon consent revocation, the collected and stored personal data of the participant will be deleted immediately.

Applicable Law

Questions or complaints relating to the raffle are to be directed to the operator. Contact details can be found in the imprint area of the website: https://www.wahbio.com/de/service/about/.

The operator's raffle is subject solely to the laws of the Federal Republic of Germany. Legal actions are excluded.

Severability Clause

If any stipulation of these Terms and Conditions of Participation is or becomes invalid in whole or in part, then the validity of the rest of these Terms and Conditions of Participation shall not be affected thereby. In place of the invalid stipulation, such legally permissible stipulation shall apply that comes closest in economic terms to the meaning and purpose expressed in the invalid stipulation. The same shall apply in the event of a loophole in these Terms and Conditions of Participation.
